And if he is appointed Labor Secretary, that will be the last straw to break the camel's back.

They change this number later in the year, since some of the FB visa allocated are retruned back to the pool (if the person getting GC does not enter the country in specified time).
They allocated a huge chunk of EB2 Visa to South Korea 7125 (currnet all through the year). Same with EB3 SK got 4727 (close to sum of India and China).
So i agree things will move slower this year but still move forward. We will not see an EB2/3 India/China Current any time soon unless they screw-up again like july 07.

My EAD is now pending 96 days..no luck..not going anywhere with USCIS - they have stopped responding also.
All your posting makes sense but I suggest each of us write a letter to CISOmbudsman explaining your case so that it gets documented and they can put some pressure on USCIS on explaining as to why across the board they are dealyed i issuing EAD renewal. USCIS keeps claiming its only 1.3% of cases thats pending but why? What reason? We all understand they may be loaded but atleast if they cant handle the laod they should admit it and issue interim EAD. Just keping mum does not help. What i cant understand is if they can approve my AP on time whats the issue with EAD?
I have really started questioning myself as to why i am in this country. Its no more a land of oppurtunity..its really disccouraging for the young graduates who are heading to this country or graduating in US Universities.

The strategy was adding poison pill. They deliberately added so many poison pill that
even EB folks were opposing the bill.
I respect your opinion. CIR failed in 2006. But if Democrats do bring the CIR up again and it fails again, it doesnot look good upon them either. So the hope is that they will check the feasibility of passing. And, we(EB folks) may have a chance to piggy back with the Undocumented and latino lobby.

No. The way I understand it, the new employer is offering you a permanent job in the same/similar job classification. So you work for the new employer in a permanent capacity after you receive the green card.
I have a question....Green card is for future employment.In that case,once your I-485 got approved ,you need to go and work for your original employer who sponsered your green card. Is that right? Is that the same case if someone uses AC21?

I think it meand one of 2 things
1) There may be sopme qnquiry telephone number or email available only to lawyers
2) They will work through the AILA liason at TSC. I believe AILA has a liason with that office who can directly bring these up with higher ups involved. Non AILA members wouldnt have office.

This is by far THE MOST RIDICULOUS suggestion on this forum I have come across.
Sorry man, this wont work for ANYONE out here. We have been waiting since TWO AND A HALF Years to file and now you want us to wait for 15 more days only to realize that USCIS may actually yank the rug out under us. I mean think about it, we will all feel like MONUMENTAL FOOLS if that happens. Try explaining THAT to your spouse who has been waiting for 2 years or more to apply and get an EAD. I know mine would KILL me if i even suggested that to her ;)
Most of us are concerned about short term goal of getting the application to uscis as quickly as possible , but think of the end result of whether your application be accepted if we rush, the uscis can come back and reject at any time from any date as it happened to Eb3-other workers. I'm going to say this once more. As much as we try, we cannot bring the Indian community under one umbrella to act together. It's a pipe dream and not achievable. I've experienced every possible Indian specimen there is in the Bay Area. Indian community in US can NEVER be like the jewish or hispanic community. What we need is representation in the corridor of power (AKA Congress/ Senate), period. No number of phone calls from mere mortals like us will equate to one phone call from big-wigs such as Vinod Khosla or Indra Nooyi.
If you are wondering if I have done anything, here's my contribution.
I approached the CEO of my company to raise my concern. My CEO was graceful and said that the government relations team in my org was already working in Washington D.C to address retrogression issues. I was given an internal point of contact who briefed me on the effort. Call it their need or greed, the "white man" seems to be more helpful in this regard.
There is no "single best strategy" - Microsoft's Ex-Chairman has testified to the Congress many times and it has been well covered in the media.
Your efforts are very well appreciated. There needs to be multi efforts, IV's efforts being just one of them. There is no stopping people to take initiatives at the State Chapter levels. What we need is more motivated leaders like Pappu, Logic_Life, Aman, Paskal, NeedHelp!, ...................., and a lot of support from common people like us ............

My take on it is that more jobs will be outsourced and only few core people important for a business will retain the jobs and also the salary hikes. This is assuming that offshoring companies mature over the period of time and move up in the service chain in terms of value of services they provide. The current trend is towards translating business requirements here and getting the programming done through some offshoring entity. The preferred vendors are benefiting enormously and so are the companies outsourcing. From a business point of view, technology is an enabler for competitve advantage. So critical and complex projects will still be done here through few core people.
I believe we can survive quite well in the global economy. I am more worried about future of American kids and the education system here. Unless they prepare well for the global economy, America will be in rude shock. Bush is not helping either, dumping the money on wars and creating boats load of debt burden for future generations.

That may be but do you actually think this practice is fair and should be legal. To me and hundreds of thousands of other folks who are patiently waiting in line, it is fraud because you are cutting in line. The sad part is we see that you are cutting in line but we can't do s**t about it just because it's legal.

How does one get to know if his Labor Substitution was rejected? If a Receipt Notice was received does that mean that it was accepted? And, can they reject it later?
Receipt Notice means they accepted the case for reveiwing. I guess these rejections came after they reveiwed the case.

My wife went to India last month on AP via Frankfurt without any visa. She faced no problems while going and coming back.
While coming back, at the Indian airports, they do check for the visa/ap/gc before they let you aboard.
I guess the confusion part is that the consulate's version of the visa requirements do not match the visa requirements enforced at the airports.
