Because, till 2005 there were extra 100,000 (total 242,000 were issued) recapturd numbers available. Therefore, no one cared (DOS/USCIS) about AC21 law that removes country quota. EB2 were curren for all then.

After folks start getting their EAD, God alone knows how many "New" desi bodyshopper's like this will spring up.
All those so called "Enterpreneurs" a.k.a desi bodyshoppers...Perhaps if someone started a company that actually makes something rather than just contracting....more jobs, more value...
I feel everyone of us has the potential to have such a vision...after all isn't this the land of opportunities

The desi companies, while their methods may not be employee friendly, also add value in the chain and that is why they exist. So I don't know what you mean by "actually make something".

Plus if the news is what we expect (ie july applications will be accepted), think about what that will do to the people who cant file in time by the end of July. There application will FOREVER be Unavailable.
I am not saying the announcement tomorrow is a bad thing. I am just not very excited

Yes, but you are missing the one important fact, that "band aid solution" would put band aid to thousands of hurt people which will sooth them for a while. I understand, your 485 is already in pipeline so you already have those band aids but claiming to be sorry portrayed you very selfish. I have old I 140 approval notice, Is it necessary to send the old I 140 approval while interfiling. What if the old company withdraw old I 140, How can I interfile in that situation.
to port..the pD..u need to send in the earlier approved 140 with the new 140 that you file..
i have read of instances when the PD was successful and few instances when it was not...
so i am not sure..what the criteria is..
but if you are in the same industry..PD porting should not be an issue..
....
i have a feeling sooner or later PD porting may be banned by USCIS..;-)

:mad: I just posted this in another thread.
I saw the show yesterday. It is very sad that people like lou dobbs are twisting the facts by saying around 700,000 H1b visa holders are overstaying in USA. Also on that show one senator named "TOM" forgot his lastname, is saying the same and also that guy even did not know how long H1B is valid, he says it is valid for 5 years after that H1b visa holder become illegal. These kind of people spread hatered among common people against immigrants. is there way, we can sue these guys for their racist remarks/ misleadeing information?
i did watch the show, i feel my blood arousing to fight back. Well, we can try exposing his false faces to other TV show hosts like msnbc, foxnews etc.
Am sure there should be some law point to help us sue this guy.

Attorney fees also increase in proportion to the USCIS Fees increase.
If you have noticed, the Attorney fees are relative to the form that they are working on. Historicaly, attorney's have increased the fees everytime there is an USCIS Increase.

You can make whatever you like of the current situtation, but let me tell you something.
There is a HUGE difference between being TOLERATED and BEING LIKED.
I am sure you have the intelligence to see the difference.
You can "tolerate" someone you don't like, but you can not "welcome" someone whom you don't like. I for one, donlt want to be in the "tolerated" category.
And may I ask, what exactly is your definition of hostility? Being chased down the street by a bunch of thugs, who think you should be in their country, or the kind of passive hostility being practised as of now?
Quite honestly, if that is how you feel - perhaps you'd need to reconsider relocating to your home nation. I'm Indian, who grew up in the Middle East. I've lived in the United States for 6 years. I've always felt quite welcome and accepted in every way possible. I believe I've been treated fairly and have had the opportunity to live with Americans and contribute in positive ways. I continue to live here, primarily based on these sentiments. I'd never live here if I felt the way you do now.

Full Disclosure.. I am an Indian
Very glad to see that these people have been caught by the law enforcement agents. These are the people who care candidates for EB1 category for greencards. As most of these join the fake IT bodyshops and show multinational executive experience on their resume. This is not the only university where you see people from Andhra Pradesh misusing law, there are many universities in the same business. I hope to see more enforement like this. I wish the USCIS and other related agencies crack down on the misuse of credential in the greencard process. Most of the IT people with fake experience and reporting structure should be punished for violating law and legitimate people with US education should get their right place in the waiting list.
My wife is on H4 visa and looking for opportunities. She gets calls from all these consultant who ask her to get on to F1 visa at some community college and then use CPT/OPT for working on their projects.....when i came to this country to study at a top ranked university, i thought F1 visa is for higher education...now it is used in community colleges. New learning everyday!!

Thats true..everybody are bothered about EAD and FP. I am here for more than 8 years in this country. IV should emphasise this and USICS should allow affected candidates like us to file I-485 and atleast get EAD. we have priority date earlier compared to others.

I support this campaign and will act upon any action item.One quick question, is the visa revalidation only for people who already hold H1 visa stamp on passport or COS from F1-H1 also falls in the same category?

Thanks friend. I do hope your prayers work for me. But I still find it strange that if someone has a pending I-485 through consular processing route, then he/she can't get a visitor visa no matter what? What if it is a medical crisis? Family reunion issues? This sure sucks. I will check with some lawyer on this.
And lastly what you detect as arrogance is my plain talking style. Did I make personal attack on anyone? no, right? Life is like a game of chess. Make the move which makes the best sense at any stage. What is the point in thinking about past moves?
I do respect your views and To me, life is little more "serious business and it deserves due respect than entertainment aspect of a game" :) I hope you would respect other's views on life too.

This thread seems to express my thoughts.
I used to wait till my dates got current. With my dates being current since November, I still wait with no sign of improvement.
I tried calling the 1-800 number. But, did not get any useful information.
Took an Infopass appointment couple of weeks back. But, it was of no use.
The officer at the local office read the same status that I see online.
She said that my case was transfered to Texas center. (I knew this since October 2007). Only additional information she gave me was that my namecheck got clreared. (Though this is important, I dont think this really matters to get my case processed).
I told her that I have been waiting since years and some of friends who filed later than me already got their GCs, she felt sorry for me but she said there is nothing she can do for me. Not even a Service Request since my dates are within the processing times.
Its getting difficult for me......Also, in this economy its getting tough everyday to hold on to the job. Who knows may be this year quota might be over too. It will definitely be a big relief if we get the GC.
I thought there is nothing I can do now till my dates goes outside the processing times. Please advice.
